TraxOps Terms of Use

1. Parties and Acceptance
These Terms of Use ("Terms") govern access to the TraxOps platform, websites, APIs, and related services ("Service") provided by TURUSA LLC ("Company", "we"). The Service is offered to business customers ("Customer", "you"). By creating an account, executing an order form, or using the Service, you accept these Terms on behalf of your organization. If you do not agree, do not use the Service.
2. Service Description
TraxOps is a cloud-based software-as-a-service product for logistics and transportation operations, including load and trip management, dispatching, fleet visibility, document handling, reporting, route tools, and integrations with mobile applications. Features may vary by subscription plan, region (e.g., Türkiye or United States profile), and enabled modules.
3. Account and License
The Company grants a non-exclusive, non-transferable, revocable license to use the Service during the paid or trial subscription term. You are responsible for safeguarding credentials, assigning roles appropriately, and all activity under your tenant. The license does not permit resale, white-label sublicensing, or use outside your organization except as expressly agreed in writing.
4. Customer Obligations
- Use the Service only for lawful commercial logistics and transport activities.
- Ensure that personal data of drivers, employees, and partners is collected and uploaded with a valid legal basis and required notices (GDPR, KVKK, CCPA, or other applicable law).
- Keep account information accurate and notify us of unauthorized access.
- Not reverse engineer, scrape, overload, or introduce malware; not attempt to access other customers' data.
5. Fees and Payment
Fees are defined in your order, invoice, or online plan selection. Unless otherwise stated, fees are billed in advance, non-refundable except as set out in the Cancellation and Refund Policy, and exclusive of taxes you are responsible for. Late payment may result in suspension after notice.
6. Intellectual Property
The Service, TraxOps name, logos, documentation, and underlying technology remain the exclusive property of the Company. You retain ownership of operational data you submit. You grant us a limited license to host and process that data solely to provide the Service.
7. Availability and Support
We target high availability but do not guarantee uninterrupted access. Maintenance windows, third-party outages (maps, hosting, telecommunications), and force majeure may affect the Service. Support channels and response targets depend on your plan and are described in commercial agreements or the help centre.
8. Limitation of Liability
To the maximum extent permitted by law, the Service is provided "as is". We are not liable for indirect, consequential, or lost-profit damages, or for operational decisions you make using TraxOps. Our aggregate liability for any claim arising from these Terms is limited to fees paid by you in the twelve (12) months preceding the event, except where liability cannot be limited by law.
9. Termination
Either party may terminate according to the subscription terms. We may suspend or terminate immediately for material breach, non-payment, or abuse. Upon termination, access ends at the close of the billing period unless immediate suspension is required; export of your data may be offered for a limited time where technically feasible.
10. Governing Law and Contact
These Terms are governed by the laws of the Republic of Türkiye unless a separate written agreement specifies otherwise. Courts of Bursa shall have jurisdiction for disputes arising from these Terms, subject to mandatory consumer protections that do not apply to B2B customers. Questions: info@traxops.com.
